Why Loved Ones Should Allow Full Property Access

When a loved one passes away, families often feel protective of their home and belongings. This emotional response is natural — but limiting access to the property during probate can unintentionally cause serious legal, financial and logistical problems.
For professional valuers, executors and solicitors to complete their duties correctly, full and unrestricted access to the property is essential.

With more than 12 years of specialist experience conducting HMRC-compliant probate valuations across England, Scotland and Wales, FEAC Legal has seen how restricted access leads to delays, disputes, inaccurate valuations and unnecessary stress.
Below, we explain why full property access is not just helpful — it is critical for a lawful, fair and efficient probate process.

Full Access Ensures the Entire Estate Is Valued Accurately

A probate valuation must reflect the true open-market value of all personal belongings (chattels) within the property. If rooms, cupboards, lofts or outbuildings are inaccessible, valuers cannot:

  • Identify hidden or specialist items
  • Document the full contents of the home
  • Provide accurate values
  • Confirm the presence or absence of family-claimed items
  • Produce a complete photographic inventory

Even a single locked room or cupboard can compromise the accuracy of the entire valuation. HMRC expects the estate inventory to be complete, not partially assessed.

Restricted Access Can Lead to HMRC Challenges

HMRC requires full disclosure of all assets within the estate. If a valuation is missing areas of the property, it may:

  • Trigger HMRC queries
  • Lead to the District Valuer’s Office demanding further evidence
  • Cause delays in receiving the Grant of Probate
  • Result in reassessment of inheritance tax
  • Place the executor at risk of penalties

A complete valuation is the best defence against HMRC scrutiny, ensuring the estate moves smoothly through probate.

Full Access Prevents Items From Being Overlooked or Undervalued

Families are often unaware of the value of certain items, especially when:

  • They are stored in lofts, garages or sheds
  • They appear ordinary but hold specialist value
  • They are part of collections
  • They are inherited pieces not in daily use
  • The property is cluttered or hoarded

Valuable items can easily be overlooked without full access. These may include:

  • Antique jewellery
  • Rare books and manuscripts
  • Militaria and medals
  • Designer furniture
  • Tribal or ethnographic pieces
  • Silverware
  • Vintage toys and memorabilia
  • Artwork or ceramics

FEAC Legal’s valuers regularly uncover high-value items in unexpected places — proof that full access protects the estate’s true worth.

Full Access Reduces Tension and Prevents Family Disputes

Access limitations often lead to suspicion or disagreements between relatives. When certain areas are closed off, beneficiaries may fear:

  • Items have been removed prematurely
  • Belongings are being hidden
  • Distribution will not be transparent
  • The executor is unable to manage the estate properly

A professional valuation with full property access promotes trust by:

  • Ensuring nothing is missed
  • Creating a photographic record of all rooms
  • Demonstrating impartiality
  • Providing evidence that the estate was handled professionally

Transparency is one of the most powerful tools for maintaining family harmony.

Full Access Allows Valuers to Work Efficiently and Safely

Professional probate valuers cannot produce accurate reports if they must work around restricted areas or wait for keys and permissions. This creates delays and compromises the quality of the valuation.

Allowing full access ensures:

  • The valuation is completed in one visit
  • All chattels are recorded consistently
  • No follow-up visits are needed
  • The process is smooth and efficient
  • Safety risks (e.g. cluttered or hazardous spaces) can be assessed properly

This saves time, prevents confusion and supports a reliable, HMRC-compliant valuation.

Executors Are Legally Responsible — and Need Full Access to Fulfil Their Duties

Executors must:

  • Secure the estate
  • Identify all assets
  • Document all items
  • Submit accurate values to HMRC
  • Distribute the estate fairly

They cannot perform these duties without full access to the property. Loved ones who restrict access — even unintentionally — may place the executor at risk of legal issues, beneficiary complaints or HMRC penalties.

Executors should always insist that full access is granted before valuation begins.

Full Access Is Essential Before Any House Clearance

Premature removal or clearance of items is one of the most damaging mistakes families make during probate. Full access ensures valuers can:

  • Determine what should be valued
  • Identify items requiring specialist assessment
  • Prevent valuable items from being discarded
  • Document everything before clearance begins

FEAC Legal also provides professional house clearance services following valuation, ensuring legal compliance and safe handling of all items.

Full Access Supports FEAC Legal’s Free Asset Recovery Service

If items have already been moved, misplaced or accidentally removed, FEAC Legal’s free asset recovery service can only be effective if we have full access to:

  • Storage areas
  • Outbuildings
  • Lofts, cellars and garages
  • Previously inaccessible rooms

This helps reconstruct the estate’s contents and ensures families do not lose financial value due to missing items.
